Karen Jacobi Dance & Cheer Terms and Conditions

These are the conditions of provision of services by GJ Dance & Cheer Pty Ltd (trading as Karen Jacobi Dance & Cheer) and herein referred to as “KJDC”.

This is an agreement between the student and KJDC. Where the student is a minor, the agreement is deemed to be between KJDC and the parent or guardian of the minor. In these terms and conditions “you” and “your” means the student. The words “we” or “us” refer to KJDC.

By enrolling in and/or attending KJDC classes, private sessions, and/or competition and performance events, you agree to these terms and conditions. These terms and conditions may be altered where necessary, and any changes will be notified on the KJDC website.

CLASS FEES, REFUNDS and CANCELLATIONS

Class fees are invoiced before the commencement of each term and must be paid by the due date on the invoice to receive the prompt payment discount as set out on the invoice.
If fees remain outstanding at the beginning of week three of the term you must phone or email contactus@karenjacobidance.com.au to arrange a payment plan. If this is not honoured then KJDC has the right to cease lessons till a payment plan has commenced.
Class fees will not be refunded for missed lessons or cancellation of enrolment. Missed classes can be made up by attending another class at a similar level within the same term as the missed lesson. This must be arranged with one of the directors of KJDC.
Please notify us via email contactus@karenjacobidance.com.au as soon as practicable if a student will not be continuing in the following term.
Fee payment options are provided on your invoice.
Enrolments partway through a term will have fees adjusted pro-rata to match the portion of lessons remaining in the term.
All family class fees must be paid up to date before student/s’ exam entries will be accepted. If more time is required a $30 “leeway” fee will be added and an additional 14 days allowed for payment.
All class fees must be paid in order to perform in the concert.

COSTUME HIRE

Costume security deposits and hire fees will be required for each student if participating in any event requiring a costume (i.e. eisteddfods, public performances, end of year concert etc.). If a student fails to pay the required costume deposit and hire fees, no costume will be provided.
Costume security deposits will be refunded on return of a costume in good condition, with expected wear and tear. Costume hire fees will not be refunded even if a student discontinues or withdraws from a performance. Commitment to performance is important as costumes need to be organised months before performance. Deposits and hire fees are essential to maintain the hiring system.

UNIFORMS & GROOMING

Students must be appropriately dressed for class in correct studio uniform and correct footwear. Uniform supplies are available from the studio shop ALL DANCEWEAR both online and at Brendale. All profits from the shop go to reducing studio costs and keeping fees to a minimum.
All students must be appropriately groomed for class, with long hair tied back securely. Female students must have their hair in a bun with hair net and pins for every ballet class. Female students with short hair must secure it with a soft headband. Male students should have their hair off their face.
Any student dressed or groomed inappropriately will be asked to improve their appearance when next attending.

LIMIT OF LIABILITY

KJDC does not exclude or limit the application of any provision of any statute where to do so would contravene that statute or cause any part of this clause 4 to be void.
Except where the clause immediately above in this section 4 applies, KJDC excludes all liability for personal injury or death. Students agree they will not sue or make any other claims of any kind whatsoever against KJDC or its directors or owners for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise, and KJDC is not responsible or liable for any indirect consequential or economic damages.
Students who have cause to bring property onto KJDC premises do so at their own risk. No liability is accepted by KJDC for damage or loss to private property. Students are responsible for their belongings and property.

CONSENT

Dance, Cheer, Acrobatics, Pilates, Fitness and associated classes and activities are physical in nature and the teacher or teaching assistant may have to assist student’s understanding of an action, posture or position by physical contact e.g. holding hands in a circle; lifting, correcting posture. You consent to directors, employees, contractors and sub-contractors of KJDC having contact with the student in this regard.
KJDC directors, employees, contractors and sub-contractors are committed to the highest ethical standards, including but not limited to those articulated through legislation in relation to discrimination, harassment and child safety.
Although every care will be taken to ensure the use of safe dance practices in a safe environment, KJDC will not be held responsible for injuries or accidents should they occur.
Students will follow all directions and set rules stated by KJDC directors, employees, contractors and sub-contractors to support safe dance practices and a safe environment.
Should a student hurt him/herself, you consent to directors, employees, contractors and sub-contractors of KJDC to attend to your child whilst KJDC waits for the nominated parent or guardian or emergency contact to take over.
Enrolment and participation in classes, private sessions and competition and performance events is voluntary based on your own assessment of your fitness, health, ability to participate and understanding of the nature of the requirements of that class/session/event, activities and expected outcomes. You further understand the nature and requirements of Acrobatics and Cheer and the increased risk of serious injury. Participation is based on an understanding and knowledge there is a risk of personal injury or death and participation is at your own risk. You are aware these are risks and the limit of liability as outlined in clause 4.
KJDC provides services on the assumption the student is fit to participate. Students are responsible for assessing their physical and mental health for, during and after classes, competitions and performance events, including injury rehabilitation and general post-event care.
By participating in a KJDC class, private session and/or performance or competition event or entering a KJDC premises the student agrees he/she is fit to participate in their selected class/es or events.
You must inform KJDC and all teaching staff of any injuries, medical conditions and allergies suffered by the student and provide any management plans.
Although, every care will be taken by KJDC to ensure a safe environment, students should satisfy themselves with the safety of class and event surfaces. If a student is not satisfied in any way with the condition or standard of any class, competition or performance area or facility, then they are not obliged to partake in the class, session or event.

VIDEO/PHOTOGRAPHY/CHOREOGRAPHY COPYRIGHT

Photographing and/ or videoing any class or year end performance is not permitted.
All choreography works are the intellectual property of KJDC. It is an infringement of copyright to reproduce, communicate, publish or perform all or a “substantial part” of a piece of choreography, unless the copyright owner has given permission or certain exceptions apply. Choreography copyrights including individual created solo’s, duet’s, group dances and “substantial” movement sequences, it also includes stage design, costume design, light design and all ideas of story and concept.
Permission must be obtained from KJDC before a student modifies choreography including design elements.

TALENT RELEASE

Grant of Rights. Upon enrolling at KJDC, you hereby grant to KJDC the absolute and irrevocable right and permission, throughout the world, in respect of the photographs and/or video footage (“the material”) that it has, has taken, or has had taken of you or in which you may be included with others: To use, re-use, publish, and re-publish, and otherwise reproduce, digitise, edit, modify, distribute in print and online, publicly display in print and online, share via social media, and publicly perform the same, in whole or in part, individually or in conjunction with other photographs or videos, and in conjunction with any copyrighted matter, in any and all media now or hereafter known, for illustration, website, promotion, art, marketing, advertising and trade. Where a student appears in such material no surnames or addresses will be used.

If a you do not wish to have your image used by KJDC, please advise us prior to the enrolment (via email), or it will be presumed you give your consent.

Release. Upon enrolling in a class at KJDC, you hereby release and discharge KJDC from any and all claims and demands arising out of or in connection with the use of the photographs or footage, including without limitation any and all claims for defamation, invasion of privacy, and misappropriation of your right of publicity. You hereby waive any claim that you may have to inspect or approve any images, products or copy in connection with any of the material.
Copyright in the Material. Upon enrolling in a class, you acknowledge that you have no claim to the copyrights in the material. The copyright owners have the right to copyright the material in their own names or otherwise and to use, assign, and license the material throughout the world, including any rights you might have.
Representations. You have read the foregoing and fully understand the contents of the Talent Release. This release shall be binding upon you and your heirs, legal representatives and assigns. You further release KJDC from any responsibility for injury incurred during any and all past, present or future photography and/or video sessions and activities.

STUDENT CONDUCT

KJDC is committed to providing an enjoyable experience and will not tolerate:
- Verbal or physical abuse
- Intimidation of any student by a student or parent or guardian of another student
- Discrimination in all forms
- Harassment or threats of any nature towards students, parents or guardians, any director, employee, contractor, sub-contractor or agent of KJDC
- Disruptive behaviour
Warnings will be given for inappropriate conduct and/or disruptive behaviour, and parents will be notified.

SUPERVISION

Parents with children under 10 years of age should supervise their children before and after class. We are only responsible for your children in the dance studio.
Students who are minors are expected to be collected from the studio door by their parents or guardians promptly at the end of the lesson. If there is an unavoidable delay, students are expected to stay within the premises. No student should wait or be asked to wait outside the studio to be collected. Where a student is to catch public transport unaccompanied please advise KJDC.

RELEASE/DISCLAIMER

Enrolment in any class or private session constitutes agreement to a waiver of liability for any injuries or illness contracted while a student is at KJDC. Students assume full risk, waive all claims and release and hold harmless KJDC, its directors, owners, employees, contractors and sub-contractors, individually or otherwise harmless for any and all claims for injuries, death, damages or losses, if any, while attending, practicing, participating in, or witnessing any class or private session as part of the class, performance or competition program, or physical activity occurring in or about KJDC premises or events.

You:

Have read understood and accept the terms and conditions of enrolment;
confirm that you are authorised to sign on behalf of the Student;
confirm you have signed of your own free will.
